Official Rules and Regulations
Olivieri “Free Pasta for a Year” Contest
  1. Enter online at www.olivieri.ca by registering to be an Olivieri insiders club member beginning on or about January 1st, 2009 12:00am EST. No purchase necessary.
  2. Limit one entry per person, household or email address regardless of your method of entry. In the event that it is discovered that you attempted to enter more than once, all of your entries will be void.
  3. Contest closes December 31st, 2009 at 11:59pm EST (the “Contest Closing Date”). Eligible entries received on or before the Contest Closing Date will be entered into the monthly draws as described below.
  4. Olivieri Foods Ltd. (“Contest Sponsor”) and Contest administrators will not be responsible for late, lost, incomplete, misdirected, destroyed entries or other error of any kind in connection with this contest. All decisions of the independent contest judging organization are final. In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the authorized holder of the email account. “Authorized holder” is the person who is assigned an e-mail address by an internet provider. In the event of any dispute regarding the interpretation of any provision of these Official Rules, the decision or interpretation of Contest Sponsor in that regard shall be final and binding upon all persons who enter the Contest. Contest Sponsor and its agents are not responsible for printing, distribution or production errors in or related in any way to the Contest
  5. There are 12 grand prizes available to be won, each consisting of: 52 coupons for 1 free package of any Olivieri Pasta 250grams – 350grams or any Olivieri Sauce 170grams or 265ml – 330ml.
    Retail value of each prize pack is approximately $260.00 CDN.
  6. Prizes are non-refundable and non-transferable. Prizes may be substituted for a prize of equal or greater value at the discretion of the Contest Sponsor, for any reason whatsoever.
  7. Random draws will be conducted by the Contest judging organization on or about the fifth of each month from February 5, 2009 until January 5, 2010, starting February 5, 2009 at 11:00am EST at 33 Yonge Street, Toronto ON M5E 1X6 from all eligible entries received on or before the Draw and the Contest Closing Date. In order to win, the selected entrants must first answer a time-limited mathematical skill-testing question without mechanical assistance and must be eligible according to the official rules. The selected entrants will be contacted by email or telephone and in the event that one entrant cannot be contacted within 21 days of the draw, one other entrant will be randomly selected for the same prize, without any liability to Contest Sponsor whatsoever. All winners will be required to sign a standard Declaration and Liability Release form releasing the Contest Sponsor and its retailers, advertising and promotional agencies and the contest judging organization from all liability related to the Contest, participation in any Contest related activities and the use or misuse of the Grand Prize.
  8. The Contest is open to residents of Canada over the age of majority in their province or territory of residence, except employees (and persons with whom they are domiciled) of the Contest Sponsor, its retailers, advertising and promotional agencies and the independent contest judging organization. Contest Sponsor may request a potential winner(s) to provide his/her occupation, employment history and employer’s name, in order to assist in verification of the potential winner’s eligibility and the potential winner agrees to comply promptly with any such request. Entrant shall cooperate fully with Contest Sponsor in any investigation relating to the Contest.
  9. This contest is subject to all applicable federal, provincial and municipal laws and regulations.
  10. The Contest Sponsor reserves the right to modify, amend or terminate this contest with no obligation or liability, subject to applicable law and the consent of the Regie (as defined in Section 11 below).
  11. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux (the “Regie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
  12. No correspondence will be entered into except with the selected entrants. By entering this contest, the entrants consent to the use of their name, city of residence, video image, and / or photograph in any related publicity or Internet posting without compensation.
  13. The odds of winning depend upon the total number of eligible entries received in each region.
  14. All entries become the property of the Contest Sponsor upon receipt and none will be returned. No responsibility will be taken for any failed communication, failure of the website during the Contest or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email, online or Internet entry to be received by the Contest Sponsor due to technical problems or traffic congestion on the Internet or any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from any material related to this promotion. The Contest Sponsor reserves the right, in its sole discretion, subject to applicable law and the consent of the Regie, to cancel or suspend the Internet portion of this contest should a virus, bug or any other cause beyond the reasonable control of the Contest Sponsor’s security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
  15. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, ON THE PART OF CONTEST SPONSOR, AND CONTEST SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
  16. By entering the Contest, all persons consent to the collection, use and distribution of their personal information by Contest Sponsor for the purposes of running the Contest and distributing Prizes, and for the purposes described in Contest Sponsor or its affiliates Privacy Policy, which is available on the Website. The “personal information” of a person is information that identifies that person as an individual, for example home telephone number, e-mail address and home address. Contest Sponsor stores personal information for approximately two (2) years. Contest Sponsor will only use this personal information internally within Maple Leaf Foods Inc. (including Canada Bread Company, Limited and Olivieri Foods Limited) and will never share this information with third- party vendors. By opting-in online you consent to use of your Personal Information by the Contest Sponsor and its affiliates to contact you to promote draws and contests similar to the Contest, promote opportunities to subscribe to newsletters or promotional clubs, and notify you about related products or services.
